D.C. Law Gives Pedestrians Extra Protection
Most car accident claims in D.C. are governed by contributory negligence, a strict rule that can bar recovery if the injured person was even slightly at fault. Pedestrians are treated differently. Under the Motor Vehicle Collision Recovery Act of 2016, a pedestrian’s own carelessness does not bar recovery unless it was a cause of the crash and greater than the combined negligence of the drivers involved.
